The terms and conditions that apply when you purchase a ticket via a SimpleTicket ticket shop.

Article 1 Definitions

1.1 In these General Terms and Conditions, the following terms (both in the singular and in the plural) shall have the following meanings:

  • 'General Terms and Conditions', these general terms and conditions of SimpleTicket;
  • 'Customer', the party that enters into an Agreement with SimpleTicket;
  • 'Event', the public or private event at which - by way of example, but not exclusively - a performance of an artistic and/or sporting nature is staged, including but not limited to a musical, theatre, play or music performance, a concert, a dance event, a show or a sports event;
  • 'Venue', the place where the Event is held;
  • 'Organiser', the party responsible for the production and/or organisation of the Event;
  • 'Agreement', the agreement between SimpleTicket and the Customer for the purchase and delivery of Tickets;
  • 'Parties', the designation of the Customer and SimpleTicket jointly;
  • 'SimpleTicket', SimpleTicket trading under the name SimpleTicket, the party that enters into an Agreement with the Customer;
  • 'Ticket', the written and/or electronic document and/or the electronic application, such as, among other things, but not limited to SMS, MMS, barcode registration via SIM card and/or any future electronic application, that grants access to the Event;
  • 'website of SimpleTicket', www.simpleticket.eu

1.2 These General Terms and Conditions apply to, and form an integral part of, every reservation for Tickets placed by the Customer with SimpleTicket and of the Agreement resulting therefrom.

1.3 The general terms and conditions of the Organiser, as well as the general terms and conditions of the holders of the Venues, also apply to the Agreement. In the event of any conflict between the provisions of the Agreement or these General Terms and Conditions and the aforementioned terms and conditions, the provisions of the Agreement or these General Terms and Conditions shall prevail. A copy of the general terms and conditions of the holders of the Venues or of the Organiser is available on request from the holders of the relevant Venues or from the Organiser.

Article 2 Information, special requests, promotions

2.1 All information about an Event, including but not limited to the price and the availability of Tickets, provided by SimpleTicket to the Customer (whether or not via the website of SimpleTicket), is provided at all times without obligation and subject to change.

Article 3 Payment methods

The following payment methods are available when booking via the website of SimpleTicket: Mastercard/Visa, iDEAL, Paypal, Bancontact, Giropay, SOFORT banking, EPS, Cartes Bancaires, Postepay, KNC-betaalknop, Belfius betaalknop, ING Home'Pay, Przelewy24, Apple Pay. This depends on the choice of the Organiser and the availability in the country of the Customer.

Article 4 Formation of the Agreement

4.1 Manner in which the Agreement is formed when paying by means of the payment methods listed above:

  • if and as soon as the Customer and SimpleTicket have determined the date of the reservation, the type of Ticket, the number of Tickets, the price of the Tickets and any additional costs, authorisation of the payment by the Customer is requested from the credit card company or the bank, whether or not mediated by or on behalf of a third party;
  • if the payment is requested by a third party from the credit card company or the bank, the personal data provided by the Customer, which is necessary for the formation of the agreement, will be verified;
  • the Agreement is definitively formed if and as soon as authorisation of the payment by the Customer has been obtained and the payment has been successfully completed;
  • if the Agreement has been formed via the website of SimpleTicket, the Agreement is immediately confirmed to the Customer by e-mail;
  • if no authorisation of the payment by the Customer is obtained, the Customer receives an on-screen message that the transaction has failed and that the agreement has not been formed.

4.2 It is not possible to amend the Agreement or to cancel or rescind it.

4.3 After the chosen payment method has been successfully completed, with the exception of a bank transfer, the Tickets are immediately accessible and can be printed via the online pages. The Customer receives a confirmation e-mail containing instructions on how to obtain and/or print the Ticket. This is facilitated via the website of SimpleTicket.

Article 5 Tickets

The Tickets supplied by SimpleTicket are and remain the property of the Organiser and are supplied by SimpleTicket to the Customer subject to the condition that, without the prior written consent of the Organiser and/or SimpleTicket, it is never permitted:

  • to resell the Tickets to third parties or to supply the Tickets to third parties in any other way, directly or indirectly, on a commercial basis;
  • to offer the Tickets in commercial expressions - in whatever way - or to otherwise refer to the Tickets.

Article 6 Liability

6.1 SimpleTicket is not responsible for and gives no guarantee whatsoever for the (artistic) quality and content of the Event and the course of affairs in and around the Venue, and accepts no liability whatsoever in this regard.

6.2 If, and to the extent that, the Event is cancelled by the Organiser or by the holder of the Venue, the Organiser will never reimburse the Customer more than the price, not including the booking fee paid, which the Customer demonstrably paid via SimpleTicket for the Tickets. In such a case, SimpleTicket never accepts liability for any other costs and/or expenses incurred directly or indirectly.

6.3 If, in the event of cancellation of the Event, the Organiser is unwilling or unable to refund the relevant amount directly to the Customer, SimpleTicket is no longer obliged to refund the amount paid by the Customer via SimpleTicket.

6.4 SimpleTicket can never be held liable for damage resulting from death, injury, accidents, harm, loss, damage or theft caused to the Customer during or as a result of a visit to the Event or the Venue.

6.5 If and to the extent that SimpleTicket is unable to fulfil its obligations towards the Customer, in whole or in part, due to force majeure, the Agreement shall be dissolved, without any party being able to derive any right to compensation therefrom.

6.6 Force majeure is understood to mean, among other things: war, threat of war and riot, restrictive measures by both domestic and foreign authorities, the death of one or more members of the Royal Family, fire, strikes, hurricanes and other extreme weather conditions, failure of and damage to equipment and equipment control systems, obstruction of or strikes in transport, flooding, lockouts, sabotage and, in general, all unforeseen circumstances both at home and abroad, as a result of which performance of the Agreement cannot reasonably be demanded of SimpleTicket.

6.7 SimpleTicket accepts no liability whatsoever for loss of the Tickets by the Customer, for whatever cause.

6.8 SimpleTicket accepts no liability whatsoever for the purchase and delivery of Tickets that does not take place at SimpleTicket, nor for Agreements that, whether or not at the Customer's request, are not settled entirely by SimpleTicket and in which a third party - for example the box office at a Venue - is involved, directly or indirectly.

Article 7 Intellectual property rights

7.1 All intellectual property rights relating to the name, the logo and any text of SimpleTicket, as well as relating to the business formula used by SimpleTicket in general, vest in SimpleTicket. The Customer is not permitted to publish, reproduce or otherwise use these, directly or indirectly, or to attach himself to them, except with the prior written consent of SimpleTicket.

7.2 All intellectual property rights relating to the name of the Event, the Venue, logos and the like vest in the Organiser or in the original right holders of the relevant Event or in the holder of the Venue. The Customer is not permitted to publish, reproduce or otherwise use these, directly or indirectly, or to attach himself to them, except with the prior written consent of the relevant right holders.

Article 8 Rules of conduct of Organiser / Venues

8.1 The Customer must comply with the rules of conduct of the Organiser and the holder of the Venues applicable to the Event for which SimpleTicket supplies the Tickets.

Article 9 Additional provisions

9.1 If any article in these General Terms and Conditions or any part of the Agreement should at any time be void or annulled, the General Terms and Conditions and the Agreement shall otherwise remain in force. In that case, the Parties shall make an arrangement for the void or annulled passage that most closely approximates the intentions the Parties had with the Agreement and these General Terms and Conditions.

9.2 Additions to or amendments of the Agreement or these General Terms and Conditions can only be made in writing.

9.3 Any complaints from Customers in connection with the services supplied by SimpleTicket must be reported to SimpleTicket in writing; SimpleTicket will ensure they are handled within a reasonable period, which shall not exceed six weeks from the date of the postmark.

9.4 All disputes that may arise in connection with the Agreement and/or these General Terms and Conditions shall be settled under Dutch law and shall in the first instance be brought before the competent court in the district of The Hague.

9.5 The foregoing is without prejudice to the possibility of invoking other legal remedies provided for by law, such as, but not limited to, the possibility of arbitration.

Article 10 Location where terms can be found and amendment of the terms

10.1 These terms and conditions can be consulted on the Consumers website (https://consumer.simpleticket.eu) and via the ticket shop of SimpleTicket.

10.2 The most recently published version always applies, or the version that applied at the time the legal relationship with the User was formed.

10.3 The Dutch text of the general terms and conditions is always decisive for their interpretation.

10.4 SimpleTicket reserves the right to amend the "General Terms and Conditions for Consumers" without having to give notice thereof in advance or afterwards.
